2. The data we collect about you

5. Disclosure of your Personal Data

We may share your personal data with the parties set out below for the purposes set out in the above.
  1. Internal Third Parties - Other companies which form part of the Tokenise Group and /or third party providers who are acting as joint controllers or processors and who are based globally and provide IT and system administration services and undertake management reporting.
  2. External Third Parties:
    • Service providers based inside and outside Barbados who provides KYC/AML services. To Tokenise Brokerage.
    • Service providers based inside and outside the Barbados who provide IT and system administration services.
    • Professional advisers including lawyers, bankers, auditors, and insurers based inside and outside Barbados who provide consultancy, banking, legal, insurance and accounting services.
    • Revenue & Customs, Regulators and other authorities based inside and outside Barbados.
In the event Tokenise Brokerage, choose to sell, transfer or merge parts of our business or our assets, additionally we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law and international best practice. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

6. International Transfers

We may share your personal data with other members of the Tokenise Group. Tokenise Group. This may involve transferring your data and your data being processed by staff operating inside and outside Barbados. We ensure your personal data is protected by requiring all companies within the Tokenise Group to follow the same rules when processing your personal data.
Personal data will not be transferred to countries outside of Barbados unless there is an adequate level of protection, and they have appropriate safeguards.
Many of our external third party providers are based outside Barbados; therefore the processing of your personal data will involve a transfer of data outside Barbados. Whenever we transfer your personal data out of Barbados, a similar degree of protection is afforded to it as we will only transfer your personal data to third party providers that are based in countries that have been deemed to provide an adequate level of data protection and appropriate safeguards.

7. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach. We will notify you and the applicable regulator or authority of the breach where we are legally required to do so.

8. How and where we store your data

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.
Personal data that we collect will not be transferred unless the territory provides an adequate level of protection. The data that we collect from you may be transferred to, and stored at, a destination inside or outside Barbados. It may also be processed by staff operating inside or outside Barbados who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your orders, the processing of your payment details and the provision of support services. Request access

We will seek to ensure that inaccurate or incomplete personal data will be rectified. You can request the rectification of your personal data if it is inaccurate or incomplete by contacting us using the details above.

Request erasure (Right to be forgotten)

You can notify us if you wish to exercise your right to erasure. Such a withdrawal of consent does not affect the lawfulness of processing based on statutory purposes which do not require your consent. data subjects that exercise this right will be removed from any marketing or future contact. We may retain a copy of any personal data if the processing is necessary for the establishment, exercise, or defence of legal claims.

Object to processing

You can object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it adversely impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes.
